Description
Summary:The aim of this research is to outline the trajectory and impact of precedents as brought by the Civil Procedure Code of 2015, with the verticalization of judicial decisions, seeking a better provision of the public service of justice, as well as contributing to a more effective and capable of improving quality of life. To this end, through pertinent bibliographies and debates in the meetings of the Research Group, the source of the institute, the way it was adopted in CPC / 2015, is observed, and that following a Precedent does not exempt the judge from the decisions, at the risk of both the nullity of the sentence and the dissociation between process and reality, insofar as the singularity of each concrete case is ignored, thus removing, in the final analysis, the jurisdiction of the very good of life.
