Summary:The present study aims, establish a comparative study between the scientific production in postgraduate courses in law, having as object the research and dissertations that have thematic analysis of indigenous peoples and traditional communities. They have been included for this purpose to the public University located in Argentina, Brazil and Peru, with the time limits for the period 1950-2015. The methodological procedure used is the analytical--interpretative research and analysis of current legislation, including in international documents, particularly the Convention No. 169 of the international organization of labour (ILO) concerning indigenous and tribal, as well as the field research in the following institutions: University of Buenos Aires / Argentina, Federal University of Santa Catarina / Brazil, Universidad Nacional Mayor de San Marcos / Pontifical University and Peru / Peru.
