Summary:This  article  demonstrates  through  a  bibliographic  and  jurisprudential  research,  the development of the Property Law, settings and environmental function through new reading of the Brazilian Constitution of 1988. The purpose is to highlight the importance of effective environmental standards, particularly control social positive use of the functions of the property, in order to answer the question of the validity of the environmental principle in the Brazilian legal system, as well as the responsibility of the owner in front of this issue. This shall be used, the legal-theoretical method of deductive reasoning in the analysis of doctrines, jurisprudence and scientific articles.
