Summary: | The 1991 Political Constitution introduced participatory democracy to the Colombian political model in order to evolve towards the Social State of Law. Therefore, different mechanisms for citizen participation and social control of public affairs have been created. In addition, anti-corruption strategies have been generated to prevent corruption. Consequently, arduous legislative and jurisprudential efforts have been made to guarantee democracy in Colombia. This article is the result of a legal research, with a qualitative approach, whose main objective was to analyze the normative and jurisprudential framework in relation to participatory democracy and electoral corruption in the period 2015-2022. For this purpose, the documentary analysis technique was used, and bibliographic records and an analysis matrix were used as a collection instrument. In order to develop the research, first, the existing regulations regarding the concepts under study were identified, then the relevant jurisprudence on the subject was determined and finally the legal scope of the existing regulations and constitutional jurisprudence on the issues addressed within the mentioned time frame was contrasted
La constitución política de 1991 introdujo al modelo político colombiano la democracia participativa en aras de la evolución hacia Estado Social de Derecho, por ello se han creado diferentes mecanismos de participación ciudadana y control social de lo público. Además, se han generado estrategias anticorrupción para la defensa de esta misma. En consecuencia, se han llevado a cabo arduos esfuerzos legislativos y jurisprudenciales orientados a garantizar la democracia en Colombia. En ese sentido, a través de este artículo se dan a conocer los resultados de una investigación de tipo jurídico, con enfoque cualitativo, cuyo objetivo principal era analizar el marco normativo y jurisprudencial en relación con la democracia participativa y la corrupción electoral en el periodo 2015-2022. Para ello, se empleó la técnica del análisis documental, y como instrumento de recolección fichas bibliográficas y una matriz de análisis. De esta forma, primeramente, se identificó la normatividad existente respecto a los conceptos objeto de estudio, luego se determinó la jurisprudencia relevante en la materia y finalmente se contrastó el alcance jurídico de la normatividad y de la jurisprudencia constitucional existente en las temáticas abordadas dentro de la temporalidad mencionada |
