Summary: | Banks often find that investors complain about the advice they are given, when their investments don't work out as planned. In a number of cases, investors make the claim that banks had given them incorrect advice. The article discusses the liability of banks in this regard, considering such mitigating factors as normal fluctuations in market prices. A comparison of cases in South African law is made with those in the German and Austrian systems [IBSSWG]. |
