Abstract The public, witnesses, jurors, and particularly the litigants, are searching for ways to first decrease the amount of time involved in litigation; second, to decrease the amount of expense involved in litigation; and third, to decrease the hostility involved in litigation. Common sense tells us that the sooner the parties to litigation can have their day in court, the sooner less hostility will exist. Going hand in hand with less hostility will be decreased litigation costs. The question then remains: What can we do to make litigation less timely, less costly, and less hostile and confrontive.
