Summary: | An attempt is made to clarify the concept of confidential information in the application of the third-party information exemptions in the Canadian federal Access to Information Act. The judgment in the recent case of Re Maislin Industries Ltd. and Minister for Industry, Trade and Commerce, Regional Economic Expansion (1984) presents an incomplete analysis of the issues. The Quebec Access to Documents Act has adopted the principles of protection of confidentiality and the need to avoid undue interference in the flow of information in the marketplace. Evidence of a different type is needed to meet these requirements. Keeping the 2 legislative purposes separate should clarify the application of the corresponding provisions in both the federal and Quebec acts and also should make the positions of those submitting and those requesting information more predictable and thus more just. |
